These Terms of Service ("Terms") govern your access to and use of the xiaoling mobile application and the website xiaoling.io (collectively, the "Service"), operated by XTEC LABS PTE. LTD. ("we", "us", or "our").

By accessing or using xiaoling, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

xiaoling is an AI companion application that combines conversational artificial intelligence with elements of Eastern philosophy, astrology, the I Ching, and related contemplative traditions. The Service is designed for entertainment, self-reflection, and emotional expression.

2. Eligibility

You must be at least 17 years old to use xiaoling. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You agree to provide accurate, current, and complete information.
• You must notify us immediately of any unauthorized access to your account.

4. Acceptable Use

You agree NOT to use xiaoling to:

• Engage in any unlawful activity or violate applicable laws or regulations.
• Harm, threaten, harass, or impersonate any person.
• Generate, distribute, or share content that is illegal, harmful, defamatory, obscene, hateful, or discriminatory.
• Attempt to extract, reverse-engineer, or bypass the AI's safety guardrails or system instructions.
• Use the Service to provide medical, psychological, legal, or financial services to others.
• Interfere with or disrupt the integrity or performance of the Service.
• Access the Service through automated means, scrapers, or bots without our written consent.
• Use the Service to develop competing products or train competing AI models.

5. AI-Generated Content

The Service uses third-party large language models to generate responses based on your inputs. You acknowledge and agree that:

• AI outputs may be inaccurate, incomplete, or inappropriate. Do not rely on AI-generated content for important decisions.
• AI-generated content reflecting on astrology, the I Ching, or related traditions is symbolic and reflective in nature, not predictive.
• We employ content safety measures but cannot guarantee all outputs will be safe or appropriate.
• You are responsible for evaluating any AI-generated content before relying on or sharing it.

6. Subscriptions and Payments

• Certain features of xiaoling require a paid subscription, processed through the Apple App Store.
• Subscriptions auto-renew until you cancel them through your Apple ID settings.
• Refunds are governed by Apple's refund policies. Direct refund requests to Apple.
• Prices and features may change. We will provide reasonable notice of material changes.

7. Intellectual Property

The Service, including all software, text, graphics, logos, designs, and content (other than User Content), is owned by us or our licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only.

You retain rights to the content you submit (e.g., your conversational inputs). You grant us a worldwide, royalty-free license to use such content solely to provide and improve the Service, in accordance with our Privacy Policy.

xiaoling integrates with or relies on third-party services (Apple, cloud providers, AI model providers). Your use of those services is governed by their respective terms. We are not responsible for third-party services or content.

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, the Service, or third parties.

You may delete your account at any time through in-app settings.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD 100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Service.

14. Governing Law and Disputes

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (SIAC), in English, by one arbitrator. Nothing in this clause limits either party's right to seek interim or injunctive relief in any competent court.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through in-app notices or email at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance.
